Dear Ms Sheila, i earn more than my spouse and all the child expenses including prenatal checkups were paid by myself. I hire a helper under my name so my spouse refuse to pay utilities equally and insist i pay for 2 shares. I pay 2/3 of the monthly instalment for our hdb flat as well and wiped out my cpf acct when we first purchased the flat. He demands to have half of the sale profits if the flat is sold and insist to have daily access to the child upon divorce. Can you advise me if my case will be strong to rebuke his demands of flat proceeds and access to child? How likely can i get care and control of child? He also demands claims on my policies which i bought before our marriage and my bank savings. Can he do that and how likely court will accede to his request?

Cos assume DP will be cancelled if we divorce? I am not working and we have two young children making things very complicated in the current circumstance. I am scared if I leave to my home country I cannot come back. What kind of support can I expect and can we file for joint custody?

My husband been paying 90% of the share of the Hdb. Will there be chance that the court will ask for zero cpf transfer over to me ? From there I will continue with the instalment. And also I understand that it’s doesn’t affect who initial the process . But does adultery affect the ancillary matters ?
Read moreSorry, (3) got cut off :) 3) Adultery alone does not affect the ancillary matters, unless, as a result of your spouse's adultery, he or she is frequently absent from home and neglects the family / children. This inevitably means that you will have to take on a greater responsibility in terms of caring for the family and the children, which may affect care and control and the division of assets.
My husband has been putting aside his assets into a trust account, which is meant for our child, for the past few years. Will the divorce case affect the distribution of those assets? If he remarries and has other children, can he choose to redistribute those assets to be shared with his new family ?

Hi again, everyone! I'm Sheila, a Family Lawyer from PKWA Law Practice LLC. I answered some of your questions previously (https://community.theasianparent.com/q/how-to-handle-a-divorce-part-1/3442850) and will be answering more now! Hope the session will be helpful for you :)
Hi there. I cant reply to your comment specifically, since it is not a separate post. In any case, if the PI report shows that it is only the both of them at her place and that he spends the night there, then it will be very persuasive.
Hi all, this Ask the Expert Session will be happening on this post and Sheila will be answering your questions by replying in the comments section, NOT on a live stream on our social media platforms. Thank you and apologies for any confusion caused.
maintenance is under fjc rite, we need to produce documentary proof? but as u said expenses that may fluctuate in future like tuition or education or swimming, enrichment etc how do we apply for additional maintenance, still need proof of payment first?
When a couple divorce and both husband and wife are financially doing ok, husband monthly salary is about 30% more than wife and if the child follow husband, does the wife obligated to pay maintenance fee to husband for raising the kid?
Hi Eve. Yes, maintenance must be paid to the care parent and in this instance, the husband, even if he earns more. This is unless there is an agreement for the husband to pay for all the child's expenses.
Hi. My husband has fully paid for the hdb without any contribution from my side, in the event of a divorce with 1 child, if I get custody of the child, will I be able to get a share of that matrimonial flat? Thanks
Ok. Thanks for the reply.
