Is there a legal definition of an unfaithful spouse, if so, what is it?

There are two different thresholds. The Court's definition of an "improper association" can include non-physical interactions, including flirtatious text messages. However, to meet the Court's requirements on adultery, there must be sexual intercourse involved.
