Need Legal Help Guidance
Dear Parents, I'm sharing this on behalf of a family member in hopes of getting some guidance or support. My sister-in-law went through a divorce in 2023. She currently has full care and control of her two children (ages 6 and 4), while joint custody is shared with her ex-husband. Unfortunately, her ex-husband has been emotionally manipulating their 6-year-old son by telling him harmful and untrue things. For example, he told the child that the money he pays for child maintenance ($500 per child, totaling $1,000) is being spent by the mother on other men — which is completely false. These comments are affecting the child emotionally. Even more disturbingly, the father told the boy about a past miscarriage the mother had, leading the 6-year-old to ask her, “Why did you k*ll my brother?” — a deeply inappropriate and traumatic thing for a child to hear. Whenever the children return from their father’s place, they show signs of distress. The older boy throws tantrums, lacks sleep, and is often overstimulated from playing too many games. Even the father's own parents acknowledge that he doesn't properly care for the kids — not even helping with basic needs like feeding or bathing them. In addition, he frequently sends my sister-in-law aggressive and accusatory text messages, continuing to harass and blame her unfairly. Can she apply for a full custody ? What is the legal process to do this ? Can she limit or supervise the father's access if he is emotionally harming the children ? Pls share your advises...
