annulment

Hello po. Sino na po dito sa inyo ang naka-experience na ng annulment na naging successful or nag-undergo ngayon sa process ng annulment? Can you share your experience po? Gusto ko lang po magkaroon ng idea from real persons po. Marami akong nabasa na sa internet about the process pero gusto ko po sana makaalam ng knowledge through experience ng iba. Salamat po.

My tita annulled her then-husband last 2016. I was a psychology student at that time kaya interested ako sa process na ginagawa nya. Medyo mahaba ang process, it took about 2 years para macomplete dahil naka base na sa abroad yung tito ko nung time na yun. Sobrang tagal ng annulment process dito satin. It could take 2-5 years, mas tatagal kung madaming properties ang kailangan hatiin or paglalabanan pa custody ng mga bata. Bukod sa napakamahal. Nagastos ng tita ko is around 230-250k just for this annulment alone. Lahat ng step na ginawa niya, lahat may bayad. First step that my tita did was to look for a law firm na maghahawak ng annulment case niya. Si law firm na ang nagbigay ng attorney na maghahandle ng case niya. This way, she'll have legal advice as soon as possible. Second step is laying out the grounds for annulment. May mga valid na rason lang na tinatanggap for annulment. Pinaka effective is void and psychological incapacity. My tita went for psych incapacity. This doesn't mean na baliw ang partner nya. She just needs to prove on documents na hindi psychologically fit ang husband nya para maging partner. She got a licensed psychologist na nagconduct ng various tests and interviews with her para magkaroon ng history report regarding marriage nila. Third step is nagfile yung attorney niya ng petition for annulment sa RTC na nakakasakop sa kanila which is QC at that time. Naalala ko na sobrang tagal nitong step na to since meron pang investigation na ginawa sa kanilang dalawa kasi bawal dito sa atin na nag usap sila na magpa annul ng kasal. Fourth step is yung mismong trial na. She and the psych evaluator was questioned regarding sa documents na pinresent sa court. Twice siyang nag hearing. Fifth step is decision. She found out na her petition was approved, pero may grace period na binigay sa tito ko para maghain ng counter motion which is ginawa ng tito ko dahil ayaw makipaghati ng properties. Ayun, nagkalabo labo nanaman. Umuwi pa tito ko dito sa Pilipinas para lang maayos nila which took another 3 months. Ang ending, nagkaintindihan din at nahati ng maayos ang properties. Annulment is a tiring and expensive process here in the Philippines pero good thing is makakapag asawa ka ulit once napawalang bisa ang unang kasal. :)
