LEGITIMATE CHILD VS. ILLEGITIMATE CHILD????
Ask ko lang. nagkakagulo kasi kame about sa “legitimacy” ng baby. Ayaw muna kasi namin magpakasal. Legitimate child padin ba sya kahit d kame kasal pero sa father yung apelido??? Or after palang namin magpakasal??? We have no idea kasi sa rules natin about legitimacy. I want to know more about the legitimacy ng baby. Thank youu!

"Article 164 of the Family Code defines “Legitimate child” as someone conceived or born during a valid marriage. Even if your marriage is annulled, any child born prior to judgment of annulment or absolute nullity of marriage is still a legitimate child. On the other hand, an “Illegitimate child” is someone who was conceived and born outside of a valid marriage. After the marriage, the illegitimate child automatically becomes legitimated and shall enjoy the same rights as legitimate children pursuant to Article 179 of the Family Code. Take note that the operative word here is “automatic". Legitimation happens automatically upon marriage of parents. In fact, the Family Code does not require you to do anything to ensure legitimation – as long as you get married, have no legal impediments at the time of the child’s birth and such marriage is valid." READ! Hindi nakabase sa apelyido ng Ama ang pagiging Legitimate ng bata, kundi sa marital status ng mga magulang nung pinanganak siya. In your case, Illegitimate Child ang bata habang hindi kayo kinakasal. Kapag kinasal na kayo, automatic na magiging legitimate child ang bata PERO may mga documento kayo na kailangan ipasa at asikasuhin para mabago ang status ng bata pakatapos niyo ikasal.
